TERMS AND CONDITIONS

By engaging our event planning and management services, you (“the Client”) agree to the following terms and conditions. These terms are designed to ensure clarity.

1. Payment Policy

A non-refundable deposit of fifty percent (50%) of the total event planning and coordination fee is required to secure the event date. 

The remaining fifty percent (50%) balance is due no later than two (2) weeks prior to the event date.

Full payments for all third-party vendors (e.g. decorators, caterers, entertainers) must also be completed at least two (2) weeks before the event date.

2. Changes and Additional Fees

If there is a change in venue or event location after vendors have been finalized and booked, an additional 10% administrative fee will apply to cover the cost of re-coordination and logistics.

In the event that the Client requests to reschedule the event to a date that has already been booked by another client, 38Seconds Events Limited will make every reasonable effort to accommodate the new date, including assisting with vendor and venue availability. However, the Company shall not be held liable for the unavailability of the original or new venue, vendors, or the inability to facilitate the event on the newly requested date. Any non-refundable deposits, vendor losses, or additional coordination costs resulting from the reschedule are the sole responsibility of the Client. If the conflict cannot be resolved, the reschedule will be treated as a cancellation, and applicable cancellation fees will apply.

3. Vendor Coordination and Liability

While 38Seconds Events will strive to engage reputable vendors based on the location and nature of your event, we are not liable for the actions, performance, or service quality of any third-party vendors, whether sourced by us or by the Client.

The Client acknowledges that vendor delays, product quality, or service failures are outside our direct control.

4. White Wedding Coordination Policy

For white weddings, only the assigned bridal assistant will be present at the church ceremony to assist the bride.

The rest of the planning team will be stationed at the reception venue to coordinate vendor setup and ensure seamless execution.

5. Media Rights

The Client grants 38Seconds Events Limited permission to use photos and videos from the event for promotional purposes on our social media platforms, website, and marketing materials, unless otherwise agreed in writing.

6. Limitation of Liability

38Seconds Events shall not be held responsible for:

  • Damages to the venue or property during the event.

  • Power outages, security issues, or disruptions caused by third parties or external events.

  • Injuries sustained by guests or attendees that are not directly caused by the negligence of 38Seconds Events staff.

  • Force Majeure: This includes adverse weather conditions, acts of God, government restrictions, or any event outside our reasonable control that may disrupt or prevent the event.

7. Last-Minute Changes

The Client acknowledges that last-minute changes can compromise the quality, timing, and overall coordination of the event.

38Seconds Events will make reasonable efforts to accommodate such changes but cannot be held accountable for any resulting deficiencies in service delivery.

8. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these terms shall be resolved amicably or referred to a court of competent jurisdiction in Nigeria.

CANCELLATION POLICY

By engaging our event planning and management services, you (“the Client”) agree to the following Cancellation, Postponement and Conduct Policies. These terms are intended to establish a professional working relationship.

1. Deposit Requirement

A non-refundable deposit of fifty percent (50%) of the total event planning and coordination fee is required to secure the event date. 

The remaining 50% balance is due no later than two (2) weeks prior to the event date.

This deposit represents a commitment and covers planning, consultation time, coordination, and opportunity costs incurred by 38Seconds Events Limited.

Opportunity costs refer to the potential bookings and revenue that 38Seconds Events Limited may forgo by reserving your event date. Once a date is secured with a deposit, we turn down other potential bookings for that same date, dedicate planning resources, engage in consultations, and begin event coordination. These actions represent a tangible investment of time and business value that cannot be recovered if the event is canceled or postponed indefinitely

2. Cancellation Policy

If the Client cancels within thirty (30) calendar days of the initial booking, the non-refundable deposit shall constitute the full and final cancellation fee.  However, additional charges may not apply provided that no significant planning activities have been undertaken — including but not limited to vendor communications, sharing of vendor’s contacts, site inspections, or third-party payment. This provision may, however, be reviewed and the additional fees partially or fully waived at the sole discretion of 38Seconds Events Limited, where it is determined that minimal work has been performed and no substantial business opportunity has been forfeited.

If the Client provides written notice of cancellation more than thirty-one (31) calendar days prior to the scheduled event date, the Client shall be liable for an additional twenty-five percent (25%) of the total agreed event fee. This additional charge compensates for administrative work and the opportunity cost of declining other bookings for the same date. 

If cancellation occurs within thirty-one (31) calendar days of the scheduled event date, the Client shall be liable for an additional fifty percent (50%) of the total event fee. This reflects the advanced stage of planning, vendor coordination, and the limited ability to rebook the date.

3. Postponement Policy

In the case of a postponement, a ten percent (10%) surcharge shall apply to the total event fee to cover administrative, vendor, and coordination adjustments. All postponements must be submitted in writing and are subject to the availability of the newly proposed date. Postponement does not waive or reduce previously agreed fees.

4. Client Conduct

38Seconds Events Limited reserves the right to unilaterally terminate this agreement and cancel the event without liability or refund in instances where the Client, or any representative of the Client, engages in rude, abusive, threatening, or violent behavior toward the Founder or any team member. The safety and professional dignity of our staff are of paramount importance.
